Winder & Counsel has been working with a consortium of attorneys across the country to recover damages against Al Qaeda and Iran for the victims of the 9/11 terrorist attacks. Our efforts in this regard culminated in the recent ruling by the Federal District Court in New York City, entering judgment against Iran for its involvement in facilitating the attacks. Read more...
We will be presenting evidence to the court in the coming months to establish the extent of damages to be awarded to the victims and their families so grievously affected by this terrible act. Of the many cases stemming from the 9/11 attacks, this was the first case to gather independent evidence of the Iranian connection and establish those facts in a court of law.

We have been retained by the Utah Attorney General’s office to recover more than $35,000,000 the State paid to ineligible recipients under the Utah Underground Storage Tank Act's Petroleum Storage Tank Trust Fund (PST Fund). Read more...
Recognizing the threat to the soils and groundwater of Utah, the legislature enacted the PST Fund as a mechanism to provide money for underground storage tank owners and operators to clean up petroleum contamination. Because over $35,000,000 was paid to ineligible recipients, it was unavailable to others. Winder & Counsel is currently working to correct these environmental wrongs and get this money into the hands of the Department of Environmental Quality and its proper recipients.

On a cold December evening in 2005, David Calder and his children arrived at their family cabin to spend some time over the holiday break. In an attempt to start a fire in the cabin's wood-burning stove, Mr. Calder applied some gasoline from a canister manufactured by Blitz, Inc. to some smoldering embers. The gas ignited and followed the stream back into the can, which exploded, engulfing the room in flames. Read more...
Mr. Calder was badly burned and his young daughter was killed. Our investigation revealed such a tragedy could have been avoided with the use of an inexpensive wire mesh spark arrestor in the can. We filed suit against the manufacture of the can for its failure to protect users of the product. In November 2010, a jury found the manufacturer liable and awarded the Calder family more than six million dollars.
